These Terms of Service (Terms) govern your access to and use of the website thehustlecollective.com.au (the Site) and any purchase of products from The Hustle Collective. By using the Site or placing an order, you agree to these Terms. Please read them carefully. If you do not agree, please do not use the Site or place an order.

1. About us

The Site is operated by The Hustle Collective (we, us, our), a collective of ten independent Barossa wine brands trading from Shop 4/76 Murray Street, Tanunda, South Australia 5352.

2. You must be 18 or over

It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years. By placing an order you confirm that:

  • you are aged 18 years or over;
  • the person who will receive the delivery is aged 18 years or over; and
  • you are not purchasing alcohol on behalf of a person under 18.

When you place your first order you may be asked to provide your date of birth to confirm you are over 18. We may refuse or cancel any order, or refuse delivery, where we are not satisfied that the purchaser or recipient is 18 or over.

3. Responsible service of alcohol

We are committed to the responsible service of alcohol and comply with the Liquor Licensing Act 1997 (SA) and the mandatory Code of Practice. We will not sell or supply alcohol to any person who is under 18 or who is, or appears to be, intoxicated. We support the responsible and moderate consumption of alcohol.

4. Placing an order

When you place an order, you are making an offer to purchase the products in your cart. A binding contract is formed only when we accept your order and dispatch the products (or notify you they are ready for collection). We may decline or cancel an order at our discretion, including where:

  • we cannot verify that you or the recipient are 18 or over;
  • the product is unavailable or a pricing or description error has occurred;
  • we are unable to deliver to your address; or
  • we reasonably suspect the order breaches these Terms or our licence conditions.

Wine is a seasonal product. Where a particular vintage sells out, we may supply the next available vintage of the same wine, or contact you first, where reasonable.

5. Prices and payment

All prices are in Australian Dollars (AUD) and, where applicable, include GST. Prices and product availability may change without notice. Payment is processed securely at checkout. If a product is listed at an incorrect price due to an error, we may cancel the order and refund any amount paid.

6. Delivery

Delivery is provided in accordance with our Shipping Policy. In addition:

  • In South Australia, alcohol can only be delivered between 8:00 am and 10:00 pm.
  • The person accepting delivery must be aged 18 or over and must produce valid photo identification if they appear to be under 25.
  • Alcohol will not be left unattended ("no safe drop"). If no person aged 18 or over is available to accept and verify the delivery, the alcohol will not be left, and re-delivery or collection fees may apply.
  • We do not deliver to any area where the delivery or possession of alcohol is prohibited (including declared dry zones).

7. Click & collect

Where you choose to collect your order from our Tanunda premises, valid photo identification showing you are 18 or over must be produced at collection.

8. Cancellations, returns and refunds

Returns and refunds are handled in accordance with our Refund Policy and your rights under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded. If a product arrives faulty, damaged or not as described, please contact us at wine@thehustlecollective.com.au.

9. Use of the Site

You agree to use the Site lawfully and not to misuse it, including not attempting to gain unauthorised access, interfere with its operation, or extract data by automated means. You agree to provide accurate information when ordering.

10. Intellectual property

All content on the Site — including text, images, graphics, logos and design — is owned by or licensed to The Hustle Collective and is protected by copyright and other laws. Individual wine brand names, logos and trademarks remain the property of their respective owners. You may not reproduce, distribute or use any content without prior written permission.

11. Disclaimers and liability

The Site and its content are provided in good faith and on an "as is" basis. To the extent permitted by law, we exclude liability for any loss or damage arising from your use of the Site, other than liability that cannot be excluded under the Australian Consumer Law. Our liability for a breach of a consumer guarantee is limited, where permitted, to re-supplying the product or refunding its price.

12. Privacy

We handle your personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).

13. Changes to these Terms

We may update these Terms from time to time. The version published on the Site at the time you place an order applies to that order.

14. Governing law

These Terms are governed by the laws of South Australia, and you submit to the non-exclusive jurisdiction of the courts of South Australia.
